Hope I can get your feedback regarding this scenario:
1st Week of Feb: Employee submitted his resignation letter and was accepted by his Ops Manager
Employee went on a 1 week VL and when he returned, he talked with his OM (with witnesses) to let him know that he is retracting the resignation. The OM said that it's okay and that the resignation will be retracted but no paperworks were filed about the retraction. The resignation later was not returned to the employee.
Feb 28, the employee was informed that he'll be transferred to another account/department and the employee agreed and underwent an interview with the new OM.
Feb 29, while on his rest day, the employee was contacted by the Site Director and HR manager to inform him that it was already his last day and that they pursued the resignation.
Employee was caught off guard because all along, he thought that his resignation was already retracted and nobody informed him. The HR manager and SD is saying that a letter should've been sent but that instruction was not given to him when he spoke with his OM. Further, he checked with another HR Manager on the previous site (same company) that he worked for and they do not have that policy in place.
The OM refused to take the employee's calls and he is now barred from entering the workplace.
Employee filed a complaint at NLRC regarding the incident.
Given this scenarion, what could be the possible outcome of the complain?
