Sir/Madam,

Pls sana matulungan nyo po ako sa inquiry ko, payo lang po at pagliliwanag sa dapat ko gawin. kamamatay lang po ng father ko noong January 2012. Kaya gusto ko po ayusin ang naiwan ng father ko. May lupa at bahay na nakuha ang mga magulang ko noong 1989. Meron silang notarized na "Contract to Sell" pirmado ng Vendor (magasawa) at ng mga magulang ko (Vendee), 3yrs to pay. Complete po ng issued payment receipt ang mga magulang ko at nagbabayad din po sila ng amilyar ng nasabing lupa. Subalit, bago pa matapos ng mga magulang ko ang buwanang bayad nila sa house & lot ay namatay po ang asawang lalaki (Vendor). Nang matapos po ang obligasyon ng magulang ko sa kanila buwanang bayad ay wala pong naganap na pagtransfer ng titulo sa pangalan ng magulang ko at wala rin po sila hawak na Deed of Sale, maliban sa "Contract to Sell". Mga katanungan, (1) anu po una kong hakbang na dapat gawin upang mailipat sa pangalan namin ang lupa o titulo? (2) Ang hawak po ba ng mga magulang ko na "Contract to Sell" ay may laban kun sakaling paikutin kami ng pinagbilhan nila? (3) Anu-anu po ang dapat naming bayaran (kun mayroon man) at magkano? (4) may power po ba ang asawang babae (vendor) na ilipat sa pangalan namin ang mga nauukol na mga papeles?

Nawa'y pagkalooban nyo po sana ng oras na masagot ang mga katanungan ko at mapayuhan nyo po sana ako.[b]

Hi! Sir/Madam,

The land title is still named after the vendor. But we already occupied the property since we started paying the monthly ammortization and initial downpayment from 1989. My mother has the Land Title and receipts. We are also the one whose paying yearly the real estate tax after we paid the full amount, but the city hall receipt doesn't show our name but still the name of the owner.

FYI, may sakit na rin po ng Alzheimer ang byuda ng may-ari (vendor) at nasa abroad na po sya. At ang pumirma na po ng huling fullpayment namin ay ang panganay nilang anak.

Sir/Madam, as i mentioned, the widowed Vendor is suffering from Alzheimer and she is in the states. Im still trying to find the whereabouts of her children (legal ages). So, what will be the possible ways to have "absolute deed of sale" to have vendor's signature affix in it?

Will there be any chance that the children of the vendors will have interest and make any problem?

Hoping for your much clearer views on this matter.

whoever will sign will need an SPA or be appointed guardian. or you file a complaint for quieting of title.
