Is it legal for us to work 10 hours a day included of lunch break for 1 hr and 30 minute break? The nature of our job is call center type for delivery.

just to clarify, do you mean your lunch break is just one hour or one and a half hours?

if you were at work for 10 hours, then the 1 hour break is not compensable, but OT premium is required for above 8 hours

We are currently working beyond 8hrs a day. If i will less 1 hr for lunch break and 30 min short break then were still working 8.5 hours a day except on our last day of the weekly working schedule. We are working 5 days a week. 8.5 Hours is just a regular working hours a day we do not receive ot premium for the 1 hour exceeded.

We supposed to be working 8 hours a day from monday thru friday and 4 hours on saturday. Since saturday is just 4 hours, our company add 1 hour eash day of monday thru thursday.

Does our company has legal basis for this working hour condition. If none, then how or what can be the remedy for this?


And by the way may I also ask. What is the prescribe period to file a case to NLRC from the day occurred the illegal termination?

that's not proper. undertime is not supposed to be offset by overtime. make a report to the nearest dole office or file a money claim at nlrc.
