Thanks.

I want to add lng sa case sai, im a regular employee po sa company ko po.Im planning to resign po pero may question lng ako, legal ba yung gagawin ko nga magrender ako ng resignation letter po ng 30 days then i will use my 15 days leave vacation/sick na benefits ko para ma cover ko yung 30 days na resignation po? please i need some input and idea para malinawagan po ako.

what you were planning was not proper. you are supposed to render 30 day notice, else you will be liable for damages.

kasi po nag resign po ako sa company ko immediate no 30day rendered but will utilize my earned 15 days VL credits as terminal leave. Been with the company for 2yrs. my reason for resignation umalis yaya ng mga anak ko single dad po ako 4 anak 12yo below. nagpasa ko ng resignation letter with attached documentation to certify na umalis nga talaga katulong ko from our brgy. Ngayun po pinapipirma ko ng employer ko ng letter authorizing them to deduct vacation leave credits sa final pay ko for not rendering 30 days. legal po ba un at dapat ko po ba pirmahan yun. ano po ba maganada gawin sa ganitong situation? salamat po in advance sa reply god bless!

that should be considered acceptance of a shorter notice period so i believe that's ok. try to work out an arrangement how to get your clearance, employment cert, etc.

Atty:

In addition to this query, terminable po ba kung hindi na magrerender ng 30days kung ang nakalagay po so contract is in the event that employee fails to render, they may be charged for the damage. Thank you po.

it's not really a terminable offense but the company can ask for damages
