you have two possible remedies. ask the dfa if they will accept affidavits from other persons stating that your husband is one and the same person referred to in the birth certificate. they used to accept this, but it seems they've become more strict.
the more lasting solution is to file an administrative petition at the civil registrar where the birth certificate was registered for correction of clerical error.
