what will i do if the birthday i'm using since birth is different from my nso birth certificate. i want to get a passport but i can't because of the said problem and dfa requires a certified nso birth certificate as a requirement in getting a passport. i hope you could help me regarding this matter as soon as possible. thank you very much!

what is your correct and incorrect birthdate?

you can try invoking RA 9048 (Primer Here), but they may refuse because it may involve your age. if they refuse, then you'll have to get a lawyer and file a petition in court to correct the entry.

or, bite the bullet, and declare your birthday on the certificate as your now official birth date.

I have the same problem. nag-apply ako ng visa but na-denied dahil kinuwestiyon ang hindi pagkaka-pareho ng birthdate sa nso birth certificate ko at sa ibang documents na pinresent ko. Ang totoong birthdate ko ay October 13, 1988 but sa nso birth certificate ko ay October 23, 1988 ang nakalagay. Ano po ba ang maari kong gawin? Thank you very much.

same as my advice previously but change in birth date is considered change in age so clerical error correction will not apply. you will have to file a judicial petition.

what are these other documents that have 13 oct as your birth date? it may be easier to just consider 23 oct as your birth day and just have the other docs corrected to match your birth certificate

Hi! I have the same dilemma. My birth certificate says that I was born "August II, 1983" (with double II) instead of August 12, 1983 and my name was spelled as ELESA instead of ELISA. Is there any chance for me to apply for the correction of both my name and birth date under RA 9048?

Or pang correct ng name lng ung law na un and ndi xa applicable sa birthdate???

i believe the name is clearly a clerical error.

the date also appears to be a clerical error so i believe it's worth a try to get them to correct it using ra 9048. if they don't agree you'll have to file a judicial petition.

No need of judicial petition under special proceedings or the so called correction of entry in live birth Certificate. What you have to do is go to your local civil registrar and ask them on how to correct your entry in your birth certificate pursuant to RA 9048.

Hello,

I have problem with my Middle name, Yung Apilyedo ng ina ko is Lindanganon, while yung nakalagay sa NSO birth certificate ko is Lindaganon, Kulang siya ng letra N. pwede ko lng ba ito ipacorrect sa local civil regestrar at hindi na kailangan ng judicial petition?

rosalyn, is your mother's maiden name on your birth certificate spelled correctly or it follows the wrong spelling? i believe this can be considered a clerical error. you should go to the civil registrar where your birth certificate was registered and inquire about their process. good luck.

i have a problem w/ my NSO live birth & LCR in my live birth copy, my family name clerically printed as "BARILE" and my birth date clerically printed as "6-12-83" in the NSO live birth and in the LCR my family name clerically printed as "BARILI" and my birth date clerically printed as "9-12-83". what should i do?

for the last name, that will qualify as a clerical error and you can file an administrative petition to correct it at the civil registrar where your bc was registered.

the birth date is more complicated. you will have to file a case in court to have that corrected. i recommend you just use the date on your birth certificate.

hello!!
ang problema ko po ay mali yung surname na nakalagay sa nso certification ko, instead of figuerra, rey ang nakalagay wala naman kaming kamag-anak ng rey..tama naman po yung name, middle name saka yung ibang nakalagay na information.yung surname lang talaga ang mali..ano po ba ang gagawin ko? mag kano po ba kung ipapaayos ito? thanks..

In my Birth Certificate, my given name appears to have no "dash", but my parents told me the other way around. And since then, I continuously and habitually use dash except when I applied for my passport(I used SPACE instead of DASH). Should I still file a petition for this to be corrected? How long would it take them(Municipal Civil Registrar) in processing clerical error??

I will highly appreciate your immediate response on this matter sir/ma'am.

killua, that cannot be considered a clerical error. to correct it, you will have to file a petition in court.

eden, i would first try if you really have to change it, but processing takes about 3 to 6 months

this can arguably fall under clerical error. go to the civil registrar where your certificate was submitted and inquire about filing a petition for correction under ra 9048

Good afternoon! May problema po ako sa birth certicate ko. My original birthday is On October 28, 1981 pero ang nakalagay sa NSO copy ko ay December 28, 1981. Lahat po ng supporting documents ko October 28, 1981 po ang nakalagay including my Marriage Certificate. Gusto ko pong mag-apply ng passport and I know I will be having a problem since all of my documents are same except for my NSO Birth certificate. Mabibigyan niyo po ba ako ng best solution for this na hindi na kakailanganin ng mahabang proseso,court proceedings at siyempre po ng malaking halaga since mahirap lang naman po kami.
Looking forward for your immediate response/action. Thank you very much and may Our Lord God Bless those people who are very Honest/True to their vows/responsibilty.

i recommend you first go to the DFA and have your docs evaluated. if they say an affidavit will suffice then good. if not for your marriage contract i would have said to consider just using the date on your birth certificate. to correct it will require a court petition.

Paano po naman kapag mali ang gender sa NSO birth Cert. Kasi nag aplly ako ng passport noy knowing na ang nakalagay na gender ko is Female intead of Male so nagpagawa ako ng affidavit at nakakuha naman ako pero sabi sa akin ng DFA kapag nag renew daw ako kilangan maayos ko na daw yon kung hindi di na daw ako makakapag renew. Paano ba aayosin yon?

Good day!

Gusto ko lang po sanang magtanong kung ilang buwan po ba ang aabutin sa pag papa-process nang maling NSO birth certificate?

Kasi po ang nkalagay pong family name sa aking birth certificate ay Melindres imbes na Melendres at ang sa papa ko naman po ay Nelendres po ang nkalagay.

Hindi po ako naka-take ng board exam ng dahil po dito kaya gusto ko po sanang ma-correct po ito as soon as possible po upang makaka-take na po ako sa susunod na board exam this coming September.
