Good evening po. Itatanong ko po kung paano mapapalitan ang entry sa birth certificate tulad ng middle name ng bata? Ang nailagay po kasi ay yung surname ng nanay.(married po kasi pero hindi iyong asawa niya ang tatay ng bata kundi yung kasama niya ngayon. Matagal na po kasing hiwalay sa asawa but not legally. Pareho na pong may pamilyang iba. Salamat po!

that cannot be corrected that way. if she goes to court, the court will order that the last name be changed to that of her legal husband.

kahit po ba hindi naman iyong asawa niya ang tatay ng bata? nai-apelyido po kasi nila sa biological father, kaya lang po nagkamali po ng paglalagay ng name ng mother, kasi mother's maiden name po di ba ang nilalagay sa form. eh nagkamali po sila. ang nailagay po ay yun name niya as married. kaya ang naging middle name ng bata ay yun surname ng asawa niya. salamat po!

any child borne by a married woman is looked upon the law as the child of her husband because the law wants to protect the child by declaring him legitimate. if it is not true, only the husband is given the right to say otherwise, and only within one year from registration of the birth certificate.

even if the mother has a dna test to prove that the child is not the husband's child, the courts will not allow it.

Sad Hi ask ko lang, about may husband's problem in his Birthcertificate. ung surname kasi nya ang naging middle name nya then ung middle name nya ang naging surname nya inshort nagswitch ung surname nya to middle name

RIGHT: Juan Marquez Dela Cruz
in his BC: Juan Dela Cruz Marquez

then ung middle name ng mother nya sa birth certificate wrong spelling din. and ung surname ng father nya wrong spelling din. He was born in Fabella hospital.
how can we fix it?and gano po katagal ang pagaayos. he supposed to go abroad last year but because of his problem nacancel tuloy.
Please we badly needs help.

moderator

try first an administrative petition under ra 9048. if they will consider it a clerical error, then it will take about 3-6 months. otherwise, you have to file a court petition.

yong middle name po ng pamankin ko ay iba ang nakasulat. hindi po surname ng mama nya .ang nakalagay po ay middle name ng mama nya pagkadalaga .pwede po ba ito for correction lang o kailangan po talaga ng court hearing /
