Dear attorney, I would like to seek your legal opinion on scope of law versus school policies or Student Manual.
Student got involved in an altercation to one of the School staff,the student cursed,insulted & humiliated the staff in public (inside the school library with many students are present).
He was brought to discipline office & the said student was sanctioned & punished based on the Student Manual which consider as major offense.This student submitted a statement admitting his guilt and he signed it and it was notarized.
All of the incident are recorded in the CCTV camera of the school.
The staff felt that the punishment of the school is too "magaan",beside the major humiliation he received in public.The student will undergo in a community service & will undergo in an Anger Management consultation.
Now, pede pa bang maghabol si "Staff" for appropriate legal punishment from our Law and the staff felt its only School Law and he thinks that the punishment is not justifiable to the scandal & humiliation he received.
Can he file a case to a baranggay court or local court just to received an appropriate justice on the incident?
What case could be filed? May liability ba ang school sa behavior ni student at sa ginawa nito sa isa sa empleyado?Yung admittance of guilt ni student with notary pede bang gawing evidence yon?
May period of time to be considered in filling this kind of complaint,it was happen wayback Dec.2010?
