Hi there!

I'm planning to resign before the year end and I just want to ask if ok lang na effective immediately?

I will make proper turnover naman and I'll secure application for clearance.

Will there be any problems in the future particularly in processing my clearance if I will not follow the 30 days notice?

Hi Atty. I am not sure if this question has been asked before. What if I want 30 days notice prior to my resignation but in our contract we need 60 days, Does the company has a right to sue us even if it is stated in the labor code that we only need at-least 30 days of notice? Pwede po ba namin gamiting dahilan yung sa labor code para ilaban yung side namin? Thanks po

this hasn't been ruled upon, but my position is that you can invoke the labor code and give 30 day notice.

Hello There!

I gave an immediate resignation to the company I am currently in. They won't allow me for the labor law says I have to render 30 days. However I haven't signed any contract upon entering and I have been almost two months employed. The only proof that I have been an employee in the duration of 6 months is the payslip in which I haven't signed that I receive every 15 days.

Is it okay If I am not coming back on the fist of january?: That would be considered AWOL right?Nevertheless I have submit my resignation and Turn over.Do they have the right to post my name in the newspaper if ever?
