good afternoon atty!

unmarried po kami ng asawa ko, pero s knya nkapangalan ung anak ko..if ever po b na mag-aabroad ako at iiwan ko sa magulang ko makukuha nia po ba ung bata?

sa mother po ang custody ng bata lalo pa at hindi kayo kasal. pero kung aalis ka dapat may letter/authorization or kung ano man ang tawag dun na ang parents mo ang tatayong legal guardian ng anak mo. Very Happy

ah ok po..kasi nabasa ko po kasi sa mga older topics na halimbawa kapag nsa abroad ka hindi mo mappractice ang karapatan mo bilang mother which is ppdeng kuhanin ng tatay ang custody eventhough hindi kasal kasi xa ang nsa pilipinas.

hindi lang naman ang pagiging present sa tabi ng anak mo ang ibig sabihin nun, if you need to go abroad para masuportahan ang mga pangangailangan ng anak mo, i think it is acceptable. yung nga lang kailangan mo maging clear kung sino ang tatayung legal guardian ng anak mo during the time na nasa abroad ka.

Most of the time sila atty ang sumasagot, pero minsan may mga members din na sumasagot at nagse-share ng kanilang experience.

ah ok po..hindi kya mg-oobject xa if ever n gagawan ko ng letter na mga parents ko ang authorize na guardian ng anak ko?kasi sinusuportahan nia nmn ung needs ng anak ko ang problema lng hindi kasi kami nakakaipon dahil pati gastos ng kapatid nia inaako nia..

if the father is determined enough, he can file a case of custody against the grandparents, and because the mother is absent, he has a chance to win custody. i am of the opinion that custody cannot be exercised through proxy.

it may be better if you can enter into a custody and visitation agreement to forestall any chance that he will try to gain custody.
