Arresto Menor

Hello Atty.,

My widowed mother has a property in her name which she would like to sell. She plans to divide the proceeds of the sale among her and her 5 children. Do we, her 5 children (her heirs), need to have an extrajudicial settlement as a requirement for the sale? The Register of Deeds advised us to have an extrajudicial settlement since my deceased father is also one of her heirs. Please enlighten us on this. Thanks.
