Government agencies are required to have public biddings in purchasing supplies, equipments and/or constructions of facilities. Bids indicating the amount and scope of work should be submitted sealed and should be opened only with all parties present and concerned. That is, contracting parties, Commission on Audit (COA) reps, bidding parties (at least 3). The contract will be awarded to the contractor with the least bid-amount.

If the biddings were rigged and there never was a public bidding and the contract was awarded to their close associate, was there a crime done?

What if the 3 bidders were close relatives, lets say, one is owned by the father, the other one is owned by the mother and the last one owned by the son. The 3 bidders worked closely with the canvasser and the head of the agency to see to it that they are awarded these contract. Is there a law against it?

That this practice constitute "falsification of public document"? What can be filed against these people?

Let's say, several administrative complains have been lodged against them including a criminal complaint, would that be sufficient, Atty.?

and also no bidding occurred.
