i need advise.... we recently filed a case of estafa.. may sinanla sa aming motor that would last for 2 months base on the agreed terms. we dont have enough space at home para igarahe ang motor na sinanla so we decided na maki usap sa isang kakilala whom we trusted..
we entrust the motorcycle together with the original or\cr to that person and allowed him to use it while in his possession but without our knowledge nabenta na pala nya ang motor na hindi pa sya rematado....he wAs able to sell it by producing a deed of sale signed by him using his name on behalf of the owner ni wala syang SPA authorizing him to transact on behalf of the owner ksi nasa amin yung copy ng pawn agreement made by the owner at ung copy of valid ID attached is the signature of the owner...
he met an acccident kaya i decided na kunin ko na lang ang motor at pagamit ko sa byenan ko pero wala syang maiproduce na motor at nalaman ko na lang nabenta na pala nya isang bwan na ang nakalipas na hindi nya pinaalam sa amin.. fortunately nabawi naman namin ang motor and we also recovered the notorized DEED OF SALE that he used in order to sell it and even the aknowledgement receipt na magpapatunay na nabenta nya ang motor at nakatanggap syang pera mula sa nakabili..
my question is it is right that we filed the correct case of ESTAFA aginst that person??
is the deed of sale valid??
