case of estafa (advise po)

gud day atty. nagwork po ako for about 3 years sa company namin. then the last year of my work, nandaya po ako ng payroll, checks and even our dollar account pero my ksama po akong gumgawa nun though ako po ung head nya, kasama ko parin xa(1.5M po kulang kulang ung nkuha namin ng ksama ko).. last april 5, 2010, nagresign na po ako then by april 17,2010 nila malamn ung ginawa ko sa company.ask ko po, wat case po pde nilang ifile saken. and pde na po ba ako magwork local or better na mag abroad nalng ako..? la p po kc akong nrerecv na any subpoena from them kc di daw po nila alam location ko..

i cannot advice you how to hide from a criminal complaint, but if they do file one, it will probably be qualified theft or falsification of private documents. good luck.

for qualified theft, reclusion perpetua for that amount. a warrant is issued after the process of preliminary investigation and a prosecutor believes that a crime was probably committed and you probably committed it. it has nothing to do with seeing you. it can be issued in your absence.

range of time is variable i've seen one concluded in weeks, some years. since you were in conspiracy, then both of you may suffer the same punishment if you are convicted.

yes, but you have to come up with a proposal which will be accepted by the offended party.

if you have an insider, find out where the case was filed. i would try to confirm if it was actually filed.

your best move now is to contact a lawyer directly to prepare your defense. i thought you said that they don't know where you are? if so they will send it to your last known address and the case can continue without your participation until the time you need to be arrested.

how long will it take po ba na marecv ko ung subpoena? at is there any instances po ba na warrant of arrest na po ung iisue nila saken kagad? ung court po ba magsasabi if how much ung vail ko or the company itself, can ask of how much they want in terms of vail po? estafa daw po ung case saken...

like i said, if they don't know your current address, it will be sent to your last known address. normally, it takes within a month for the subpoena to be issued and received.

you can still work locally. if you go abroad, then it will be more difficult to defend against a criminal charge.

i cannot advise you to escape a criminal complaint. I hope you will reconsider and face the criminal charge. i cannot speculate on when an arrest warrant will be issued.

hi atty. question lang po. how many times po ba dapat makareceive ng subpoena for estafa case? nakareceive po kasi kami twice kaso hindi kami naka attend to defend ourselves so, may nagsabi sa amin na may warrant na daw na darating so para hindi kami hulihin pwede daw kami mag bail ng maaga. may pwede pa ba kaming gawin para makapag file kami ng counter affidavit? or para hindi na kami magbayad ng bail? salamat po.

once is enough. the advise given to you is correct. file bail asap then file a motion for reinvestigation, but i don't know how it will be granted because you even admit that you received a subpoena twice and ignored it.
