mejo napapansin ko po na madalas nang pag usapan sa mga forum ang tungkol sa pagkalat ng mga scandals,
may nabasa po ako na maaari daw gamitin ang republic act 4200 anti wire tapping po yata ang batas na ito,
maari daw pong kasuhan ang nagpakalat ng scandal maging ung mga napasahan ng scandals sa pamamagitan
ng batas na ito, therefore pati mga nagdownload ng scandal ay madadamay
totoo po ba ito, bilang mga experto sa batas, ano po ang inyong masasabi?

and isa pa pong nabasa ko ay sa right to privacy law daw po,na matatagpuan sa civil code at revised penal
code,pwede din daw pong gamitin ang batas na ito laban sa nag upload at maging ng nag download ng isang
scandal, totoo po ba ito?

halimbawa po na may nakita akong scandal sa cellphone ng isang tao, pwede ko na po ba syang ipahuli

Malabong magamit ang RA 4200 dahil ito ay tumutukoy sa pagrecord ng pribadong usapan ng ibang tao. maliban lamang kung ung tinutukoy mong scandal ay ung usapan ng iba gaya ng "Hello Garci Scandal"

Section 1 of R.A. 4200 entitled, " An Act to Prohibit and Penalized Wire Tapping and Other Related Violations of Private Communication and Other Purposes," provides that it shall be unlawfull for any person, not being authorized by all the parties to any private communication or spoken word, to tap any wire or cable, or by using any other device or arrangement, to secretly overhear, intercept, or record such communication or spoken word by using a device commonly known as a dictaphone or dictagraph or detectaphone or walkie-talkie or tape recorder, or however otherwise described.

sa mga kumukuha ng video at nagupload o nagpapakalat ng sex scandal, maaring gamitin ang Civil Code provision

(a) prying into the privacy of another’s residence; (b) meddling with or disturbing the private life or family relations of another; (c) intriguing to cause another to be alienated from his friends; (d) vexing or humiliating another on account of his religious beliefs, lowly station in life, place of birth, physical defect, or other personal conditions .

maaari rin gamitin mga special penal laws lalo na pag mga bata ang biktima.
