We were married last 2009 and got a copy of marriage contract in NSO. Lately, we are adopting a child with no birth certificate yet and so we are trying to apply for late registration. One of the requirements is the CENOMAR. We never had this when we filed for our marriage certificate by that time so we requested a copy. Much to my surprise. My husband got 2 results. He then told me that his previous marriage was fake and the woman was now married to a Japanese. They got married in Manila city hall April 2000 but as per NSO, it was filed in Quezon City District. Please advise how we can annul the previous marriage so only our marriage will appear. We have no contact on the alleged wife anymore as she lives in Japan now. Please advice

the first marriage is presumed to be valid, and yours is void for being bigamous, and your husband can be prosecuted for bigamy. you also if you knew about the first marriage.

what is important is whether there is a valid ground for the first marriage to be annulled: http://www.pinoylawyer.org/t4792-grounds-for-annulment-declaration-of-nullity-legal-separation-and-separation-of-property

in my opinion, even if the first marriage is invalidated, yours will remain to be void, and they will always appear in the report of marriage/cenomar but with additional remarks if annulled.

regarding the birth certificate of the child, i hope you are not making it appear that you are the parents when you are not because that is the crime of simulation of birth.
