need legal advice po..
Last sat.(sept. 3) nagpunta po ako sa SM Megamall, Bumili po ako ng netbook sa Asianic Cyberzone 4th fl. then i decided to go to dept store, tumingin po ako ng shoes sa "Keds", nagsukat po ako ng shoes, sa kadahilanan po na may mga bitbit akong bag & plastic(netbook inside) nagdecide po ako na iwan yung bag & plastic sa chair but binilin ko po sa saleslady na look after my things, pumayag naman po ung saleslady, 1st na pagbalik ko my things are on their place naman then nagsukat po ulet ako ng shoes pagbalik ko po chair very sad to say Sad wala na po ung bag ko. Nasalisihan na po ako. at hindi man lang daw po napasin nung saleslady
pwede po b akong magreklamo against sa saleslady/SM Management?
Nag ask po ako sa security ng SM Megamall kung may CCTV sila, they said limited lang daw in entrance, exit, cashier area. Nakausap ko po ung manager ng dept store customer service, isa sa mga sinabi po nya na "hindi n daw part ng work(policy) ng mga saleslady na batayan ung mga gamit ng customer but because of goodwill ng saleslady kaya daw po pumayag ung saleslady. If yun po ang policy nila bakit hindi na lng nila inimplement, no problem naman po sken kung sinabi or inadvice saken ng saleslady na hindi sila pwedeng mgbantay ng gamit. I will bring my things kung un po ang policy nila.
Meron po ba akong legal action na pedeng gawin

my suggested remedy for you will be to send a demand letter to both the sales lady and the company, and then file a small claims case. rules on sc.judiciary.gov.ph

to my mind, you will have a better chance against the sales lady, not the company. you can argue that it was made to appear that she had the authority to agree to your request.
