Atty good day po.. Ask ko lang po kaci may pinapapirmahan sa amin na "certification" ng pagkautang sinasabi ang term na 10% every 10 days at yung amount ng utang amounting to 6k.

1.) Dapat ko po bang pirmahan yun sa pag accept na may utang kami? pero pano po kung hindi sya pumayag na ayaw naming pirmahan ung kundisyon nya na 10% kada 10 araw, 30% isang buwan, di po ba sobra na un? wala naman syang licensya na nagpapautang sya at bakit singil ng ganun kalaki, ano po ang dapat kong gawin?

2.) Tuwing nagtetext po sya dapat ba talgang sagutin? tama lang po ba na sabihin na wala pa akong pambayad ngayon, antay lang?

3.) Tama bang certification ang ilagay sa heading sa pipirmahang kasunduan?

antay ko po ang tugon sa mga katanungan ko atty.

i would not recommend you sign that agreement. without a written contract, interest is not enforceable.

it's up to you if you will respond.

hi atty, meron po kasi akong pina-personal loan sa office namin. we signed a contract and we have a witness who signed too. kaso na -terminate ung debtor then got another job after 2 months from termination. tapos nagsabi sya na ituloy lang daw ung interest while she's not able to pay pa.nagka-work sa sa abroad and kept leading me on that she will pay after sending the computation until 2months ago she stopped responding to me about the debt. over a year na syang hindi nagbabayad.do i have a ground to sue her kasi medyo malaki rin ung amount. thanks. hope to hear from you soon.

no checks involved? if not, this is a collection case. send a demand letter to her last address. you can file a complaint at her bgy, but it won't move forward unless she's here.
