this person said bad things against me thru a relative of mine. can i use my relative as witness or have my relative make a sworn affidavit that he did say those bad things against me? can i sue that guy for slander by deed?

hi again.
what if my friend file a case of oral defamation to the wife of his exboyfriend. because in front of her mother the wife do tell so many bad things about her.it was below the belt.which is not true.also aside from her mother somebody also heard her sayings.
will her mother be a strong witness for her case that she want to pursue?
will the case prosper? what will happen if so!

cheetoz, if you live in the same city or municipality, begin by filing a case of slander at the bgy.

attylll- from what i know the brgy can summon him
3x but is he doesnt show up all the brgy
can do is gv me a cert. to file legal
action. and as we know most pinoys doesn't
give too much attention on our brgy
officials not unless the charge is really
that serious? can i go straight to court
on this or should i just send first a
demand letter fr a lawyer?

demand letter is not necessary, but bgy proceedings are required. your case might be dismissed without it.

attyLLL- ok. since im abroad, can i still file for it at the brgy when i get home? does this have a time limit? if yes how long? & if i go beyond the time limit , does this mean i cant complain anymore at the brgy??

you have 1 year. what you can do now is to issue an spa and an affidavit at the phil embassy to authorize someone to represent you
