Need help po regarding a case. Few years back my team rented a self-drive van dun sa colleague namin. On the way back nagoverheat sasakyan so we called yng driver na ngiwan ng van nmin and requested for refund kc nga d nmin ntapos yng araw. So nrefund po kme then tinow na nla sskyan. Few months after yng colleague na contact namin sa van and the driver e nakasuhan nung rental owner. Negligence daw nila kaya nasira van and demand is about 90k. So binalikan kmi nung colleague and we helped him na kausapin owner for settlement. The amount was too much. Then we found out na pinagawa pala nila yng van then tnest drive sa malayo then nasira na ng todo pati makina. That's where the 90k came from. So d kme pumayag na samin pabayad ganon kalaki amount when initial sira was overheat at radiator lang.
We didn't get a hold of the update onthe case for sometime until recently we found out na natalo faw yng counter ng colleague namin at garnishment ginawa ng court, salary deduction of about 87k+.
Pwede pa po ba irefile ang case or mg appeal? Considering ngpprent sila, we do not agree na dahil ngoverheat samin ang sskyan e kami nkasira. We dont even know if in good working condition nga yng sskyan for long driving or baka ntyambahan po samin na tuluyang bumigay.
Meron unang mekaniko tumingin nung van right after ngoverheat at sinabi radiator nabutas. So replacement lang, also they issue us a receipt sa rental payment na hindi po sakanila nkrgister ang business name. Kase bahay lang ang pwesto nila. Now we wonder bakit ang laki ng hinihingi. I have yet to contact yng colleague regarding any letter he might have received kasi po ang claim ng colleague namin is wala dw sya natanggap na sulat then all of a sudden hnold ang sweldo nya.
Also, who is really responsible for this? Ang ngdrive po is yng husband ng ka team ko n i just happen to be the oic in the team building. Hindi po ako nakasakay sa nasirang van but out of goodwill we,as a team,would want to help out in anyway we can pero masyado po malaki ang hinihingi.
