It should be paid out within "reasonable time" - ask them about the normal time frame.

If the wait time exceeds what they say, make a follow-up.  If they cannot give a valid reason for the delay, you may wish to file a complaint.



I am one of the many BPO veterans out there, I have a few questions for the moderators, HRpractitioners, and legal counsels about the specifics of "reasonable time" if this is the case..

09/18 - girlfriend and I worked for the same BPO company, her clearance was completed after her resignation earlier the same month;
09/20 - my clearance was completed, and I will quote the fine line of "..within 60 days to release the backpay" which is initially fine, however..

10/30 - girlfriend got her last pay, and until now I have no idea about the whereabouts of my backpay as the liason in charge is no longer responding to my emails. can this already warrant me to go to nlrc to file appropriate charges?..is this enough probable cause to sue my company, or if there are other suggestions that you can advise amidst all the email follow ups that i have been doing to reach out before I take this elsewhere? lastly, is the company required that upon the release of backpay, provide a breakdown of the amount written in the check?..your professional advise is highly appreciated..thank you

Update from my last night..

At last, my company is asking for a quit-claim to be signed before i-release ung backpay ko, pero walang details nung tax refund (breakdown) on how it came up to that figure. System generated daw yun and it will be requested pa sa outsourced payroll team..Needless to say, i did not sign the quit claim and walked away for the meantime.

wala man lang 2316, or COE na in-iissue, just the check alone..

may legal obligation po ba na magexplain si company before nya papirmahin ng quit-claim si employee?..o common practice lang un talaga?..

maraming salamat po ulet..

No law.

What does the company say?

It has to be within reasonable time.

They haven't provided a time frame regarding the release of my last paycheck and worst I could not even contact any of them. It's been 2mos now and have yet received any updates from them.what should I do?

Hi,

I left full-time job to do online work for personal reasons. I got work as online PA for a small company in UK starting October 6, 2014. After end of October, I unfortunately did not receive my salary via PayPal as per contract. After two weeks have passed and many empty promises, the owner finally paid on 14 November, but only gave partial payment. By start of the following week, I have followed up several times on the payment of balance, but nothing has been paid as of this time. This doesn't sit well with me (although, I've remained professional and polite with my communications with them) and so I decided to discontinue my employment and submitted my irrevocable resignation. As of this time, I have not gotten any feedback as to when owner intends to pay; my emails have not been replied to.

I need help on how I can go about this considering that my employer is based in UK. Thank you.

Good day po. Regarding po ito sa resignation status ko ngayon. Nagresign po kasi ako sa company ng August 16, 2017 (which shall take effect on Sept. 16, 2017). Mula po nung nagsubmit ako ng letter of resignation, more than 12 days na po akong absent. Makakaapekto po ba ito sa pagiging cleared ko po sa company and sa release of COE and backpay ko? Required po ba na mag render ng 30 days of service?
By the way, 1 month pa lang po ako sa job ko ngayon. I hope you respond po. Thank you!

Is the company being fair lenient when the HR officer said that my absences won't that matter since I've already submitted my resignation and that I'm not connected to their company anymore? Is this legally right?

It is required to render 30 days notice.

The HR personnel might be lenient however, he have no final say in the matter. you are still connected with them until the last day of your work. The head of the department that you are on have final say in that since they are the one affected.

2. Required po ba na mag render ng 30 days of service? - SYEMPRE OO, dahil hindi pa effective resignation mo. Ibig sabihin e empleyado ka pa din ng kumpanya. At pwede may kontrol pa din ang kumpanya sayo.

Kung 12 days ka ng absent, pwede na silang mag-process ng BTWO at i-terminate/tanggalin ka sa kumpanya by reason of Job Abandonment dahil nag-AWOL ka.

Sir HrDude thanks po sa pagrespond pero yun na nga po pinagtataka ko. Nakipagcommunicate na po kasi ako sa office. Nasabi ko na rin po ito sa taas, hindi na daw po ako konektado sa kumpanya since nagsubmit na ako ng resignation. And hindi na daw po magmamatter yung absences ko. Totoo po ba? So yun, logically confusing lang po.

Kung separated kana sa kumpanya e humingi ka ng dokumento. Kung resigned ka e dapat may kopya kang 'approve' nila ang resignation mo.

Kung separated kna sa kumpanya e talagang wala ng saysay pa kung pumasok ka o hindi.

Separation sa kumpanya sa KAHIT ANONG dahilan ay may karapatan ang empleyado na mabigyan ng COE at 2316 Form.

I just like to know if theres any possible win for the case of delayed back pay from my previous employer? I worked in a BPO industry as an agent for 1 year and 3 months then resigned. I processed my clearance and rendered 30 days period and it all went perfectly fine. Now
We had an written agreement that the process for the back pay will only last for 90 days however after i was cleared in my previous company, until now i haven't receive my back pay its almost 150 days already and I'm still waiting for it. I did go to the office to talk to them and ask a valid reason why theres no notification that was sent to me no calls text nor emails for the status of my back pay even though i tried so many times to follow it up. No efforts had been made by them i even talked to the HR manager and accountant and they admitted there mistake about it. Now that i filed against them i would like to sue them for the damages they've done to me because of the inconvenience happened and all. I would like a direct to point legal advise from you if I am going to take this to the arbiter or just settle them in SENA instead?

Hi sir,
May icoconcern lang po sana ako. About po sa backpay at mga original copy ng requirements ko. Almost 3 years po ako nagtrabaho sa company na napusakan ko, under po ng agency. Nagresign po ako noong september 30, 2017. Nagpaclearance na din po ako sa kanila. Ang sabi po sakin 2 to 3 weeks yung process. Mag 2 months na po hanggang ngayon hindi pa po nila binibigay ung last sahod ko, back pay and mga orginal na requirements. Tama po ba na ganito katagal yung process? Hindi po kasi ako makapag apply sa iba dahil yung mga original na requirements ko nasa kanila pa. Lage ako nag follow up sinsabi na 2 to 3 months daw. Parang sobrang tagal naman po kasi. Anu po kaya dapat kong gawin?

yung agency ang dapat nagbabayad ng sahod mo. have you tried asking them? yes two months is quite long. if hindi mo pa makuha magsumbong ka na sa dole and file sa nlrc afterwards. ang unahin mo is yung agency dahil techinically sila ang employers mo
