Arresto Menor

I have a houseboy that uses my cellphone to call his girlfriend and for overtime the billing accumulates reaching P50,000, can I sue him for Qualified Theft? If not, what complaint I can file against him since his hiding?

how did he get to access your phone? he would take it without permission? if so, i believe a case for qualified theft will prosper

Actually I assign it to him to use it to call me but without me knowing that he is using it to contact his girlfriend. Too late when I found out because he already stop going to work.
