Hi! I'm fernandojose. I'm not a lawyer nor am I a law student. I came across this website because I need help for my problem. I applied for an immigrant visa for Canada under the Federal Skilled Worker class. Base on their criteria, I qualified under one of the 29 listed occupations. I engaged the service of a "visa service company" to ensure that all documentations will be prepared and all forms be properly filled up.I chose the said visa service company because they were referred by a close friend and they have a full money back guarantee if the application is not successful. A full refund of their professional fee and the embassy fee paid to Canada, will be given if application is rejected or refused in the paper stage. My application was refused because of insufficient years of experience. This is not true in my case as I have nearly 2 and a half years experience in my profession. The immigration officer came up with this reason because of numerous documentation errors. Changes were made in the application forms which weren't approved by me since I was never inform of those changes in the first place. My file in the Canadian Embassy remains close even after I made an appeal for a reconsideration. Anyway, I informed the visa service agency that I'm requesting for a refund of my fees. They refuse to refund the fees. My questions are: (1) can I sue the visa service agency? (2) what case will I file against them...is it breech of contract? (3) how much and how long will the case take if I sue the visa agency? (4) Do you know what government agency/agencies can I report the visa service agency to complain about their "unfair" or "fraudulent actions"? (5)they are a SEC registered company, what can be done to them is proven that their action have "defrauded" their clients? I feel strongly about this issue because my application was refused not because I didn't qualify but because of their documentation errors, and yet instead of giving back my refund, they refuse citing "I'm not so sure if true" technicalities. Instead of doing the honorable thing of returning my fees, they just add another insult to my injury. Sorry for the long story but hope you can answer my questions. Thank you.
