Quasi delict I need advice

I need an advice from you people of the law or people studying law. I own a local franchise restaurant here in the Philippines.

This is what happen. We have tables setup near our parking lot. One day a family with 2 minors (our customer) was dining in one of those tables near the parking lot. Suddenly a car (I own that car, but not driving) that was about to park rammed the table of that certain family and causing multiply physical serious injuries. The family was hospitalized and it so happen my insurance company never settled the hospital bills of that family. There is a police report that we will settle the bills, but we never did (my insurance that is). The family paid their own hospitalization during their stay at the hospital.


That family now is suing me, they filed a civil case against our establishment and a criminal case against the driver of my car.

They are suing me for millions, should I settle it out of court or fight till the end?

Any legal advice?

why didn't the insurance pay?

I have a lawyer but I need a fresh point of view. I am still looking for the insurance adjuster on why they didnt pay. In your opinion what are my chances?

found the insurance adjuster, my insurance didn't pay cause the other party refuse to sign the affidavit of desistance. Cause the adjuster wants them to sign the affidavit first before they will pay the hospital bills and the other party refuse to sign it first. So this is what gotten me into this mess right now, because of this insurance policies.

any reactions on the forumers here? violent or not are welcome.

mangvic, the insurance company can release the payment to you and you can settle with them directly. you will execute a waiver to the insurance company. that way, you can waive the desistance.

as for merits of the case, you should discuss this with your atty.

no, what i mean is that there is a way for you to get the insurance money even if there is no desistance. again, you should discuss this with your atty.

thanks for the reply, what i have learned from this experience is never judge a person by how they look. They really look simple, but turns out they belong to one of the prominent families. I should have settled the medicals personally. tsk tsk
