Arresto Menor

my husband constructed a house for a subdivision developer.unfortunately after completion of the house no payment was made.it's been 8 months.vebal demand made still no payment.now the subdivision is in a process of foreclosure.the owner of the subdivision is a korean national.what case should we file against the ownwer?
