I'm a mother of 3 children. My husband left for the USA since 2004. In around 2008, he asked me to sign divorce papers saying he has to have arranged marriage there. eventually he got married.. Now things have changed.. I learned that he already have 2 kids and living with her wife who is a pinoy but U.S. citizen.

Is there a case of bigamy against him since our marriage here in the Philippines is not annulled and I know that divorce does not apply to him since he is a Filipino citizen..

he is legally married there in view of the divorce docs.. according to him it was on December 16, 2009. Up to now his green card is still revocable..
Is there anything i can do to stop his US Citizenship later on?

Also, in a bigamy case, can I demand for child support later on? The man had no work but the new wife is a nurse and is the sole breadwinner of their family now.

could i file charges against the wife also?

will the extradition treaty between the US and Philippines apply in this case?

in the opinion of most lawyers, bigamy under philippine law will not prosper because the second wedding was celebrated outside of philippine territory. until the supreme court resolves this, my opinion is that they can still be held liable because the marriage legally subsists everywhere.

but you will need their 2nd marriage certificate if bigamy case is to be filed. that picture will not be enough.

will your husband still visit the philippines? you can file an economic abuse case against him and have the warrant executed if he comes here.

but is there a way that their marriage could be verified from the DFA or Immigration office. He was here in the Philippines last May 5-23, 2011 to visit us. He got his green card in view of the marriage..

So, sir, until i dont have a copy of their marriage certificate, wala na akong habol sa kanila...

so he was able to run away from his responsibilities to us just like that?

is there a way that the DFA could call his attention about this matter?

too bad you didn't take action while he was here. i do not know if the dfa will help you, but you can certainly try to contact the consulate nearest to where he lives.

sir,
in the event that he will come home again with or without my knowledge, what is there something i can do... to take action..

is it something i can do or file in court now?

what are the documents required to file it?

sir, do I need a lawyer to make this demand letter? and how do i file for economic difficulties? what are the requisites to this? he has been sending us money monthly as far as i can remember though small amount, but lately i just learned that it is the wife's money he is sending us... now we are left at the mercy of his wife on whether they will send us money or not anymore..

about writing the consulate office, do i need a lawyer to do this? will this bar the renewal of his greencard by december this year?

if he is sending regular support, a complaint for economic abuse will be difficult to prosper.

if you can draft the demand letter yourself, you won't need a lawyer. there are samples on the net.
