ask ko lang po kung paano ko po malalaman kung totoo ang SPA na hawak nung seller. Kasi may balak po akong bumili ng lupa, naka usap ko na po yung seller, ang sabi po nya yung may ari ng lupa ay nasa ibang bansa. sya ang pinag aasikaso para maibenta yung lupa. meron daw po syang SPA. regarding naman po sa titulo, sa lunes ko pa makukuha yung xerox copy to verify it sa register of deeds.

^Check mo, kailan ba nabigay ang SPA sa Agent, kung nasa ibang bansa na ang owner nun nabigay ang SPA, dapat Philippine Consul ang nagnotarized noon, may RED RIBBON... PERO kung nasa Pilipinas pa noon ang may-ari, check mo sa Notary Public na nagnotarized kong mayron nga siyang na-notarized na ganun SPA. Ingat ka, kasi kung hindi valid ang SPA, magkakaroon ka nang problema dito.

last nyt we met the sellers rep. yung spa po nila d2 ni notarize sa atin sa makati po. Ang kaso po june 28. 2009 pa po ang date. d po ba 1 yr lang ang validity ng spa? voidable po? isa pa pong problem na nakita namin, sabi po nung representative hiwalay na daw po yung mag asawa na may ari ng lupa, the ex husband nasa canada na, the ex wife nasa australia naman. kaya mahirap for them na makipag cooperate, and besides they are not in good terms (may ari ng lupa)
yung ex hubby lang po ang may valid ID, yung ex wife expired na po ung ID na prinesent.

medyo complicated na pala, kasi since conjugal ownership ang property, dapat both spouses are willing to sell the said property, kung may isa sa spouse na magqquestion nang sale, makakaproblema ka kasi may idea ka na from the begining na hiwalay na pala sila.
