Hi, i want to ask for a legal advice regarding this situation:

I have met a Japanese man here in the internet last year. He was a good man and he also gave or sent me some money as a gift or present (in which i didn't ask from him or demand about it). Then, he gave me money to buy a laptop. Since he gave big amount of money, he said to me that i will be paying him through an installment basis. So i agreed to pay him monthly. It was an agreement through email, no contract signing or whatsoever because we only exchange through emails. For the first 3 months, we were good then suddenly he changed his mind and told me that he will get the laptop back because he found a another girl and that this girl wants to have a laptop. In other words, the laptop will be given to the girl or to the brother of the girl. I told him that i will return the laptop but i will not give it to them since i don't know them and it was you who gave me the laptop so you will be the one who should get it, not other people. Then he started to curse me, got angry to me and said many horrible things about me. He was blackmailing me in his mails, threatening me and try to frighten me and demanded many things. What do you think i should do about this situation? I want to know what i should do about him. Should i return the laptop to those people too?

yes i did... for the first 3mos. I just haven't replied to one of his mails, after that, he changed his mind and wants to get the laptop back.

ainikris, i recommend you ask for a refund of your payments and then just turn over the laptop. you have emails as your proof. ask the person who will pick it up to produce IDs and you photocopy them.

atty, i asked for a picture first of the person who will be receiving the laptop but i think the japanese man doesnt want to give one, instead he demanded that aside from returning the laptop, i should also pay him too.

moderator

my recommendation is that you retain all your communication. i hope it clearly shows that you entered into a loan agreement to buy the laptop. that makes the laptop yours, and your next agreement to give the laptop is your way of extinguishing your loan.

you should inquire at the register of deeds how the property was transferred from your lola to you uncle. ask for the copy of the deed of transfer. my guess is that it may have been falsified, and that will be your basis to question his ownership and the sale.
