Hi, I would like to seek advise regarding delayed construction of our house.

I have a contract (signed by me and the contractor) with a home improvement firm which shows that the construction will be completed in 55 days. However, until now the construction is not yet finished (start date of construction is February 18, 2011).
Unfortunately, we already paid the 90% of the contract cost.

Can we cancel the contract and demand to give back to us part of our payment? Or is there a better legal move, to force this contractor to finish the project.

send a demand letter to first establish that you are objecting to the delay. hopefully this will push them to finish the work, then you can claim damages for the delay.
