Bumili po ako ng bahay sa tita ko, nakapagbayad na ako pero ayaw niyang pumirma ng transfer of property.....

need advice, ano po ang pwede kong gawin?nakapagbayad na po ako sa bahay ng full payment pero nung papapirmahan ko na yung papel regarding sa pagpapalipat ng property ayaw pumirma ng tita ko. ngayong kinukuha ko na lang bayad ayaw niyang ibalik saken. ano pong dapat kong gawin?

nasa japan po kasi siya ang sabi niya po pagbalik niya sa pilipinas saka na lang siya pipirma. pero po pagdating niya ayaw na po niyang pumirma dahil mali daw po ang pangalan niya sa lupa. nakapag-asawa na po kasi siya ng iba,kaya ayaw niyang tanggapin na ang apelyidong nakalagay sa property niya ay sa dati niyang asawa. pinipilit ko po na kung ayaw niya naman palang pumirma isoli niya na lang yung binayad ko pero po ayaw na din niya dahil upahan ko na lang daw. hinde nman po ganun yung naging usapan namin nung una.

Hi, we live in a subdivision and the Homeonwer Association president is claiming that the front of our house where there is a garden with plants and trees is public property thus he wants to convert it into a sidewalk. This is without consulting us owner. Is this valid and can he really do this to any ones property ?

mjane, i recommend you try to negotiate a way to make the sale effective. if not, you'll have to file a case to rescind the sale and collect the money you paid.

jorox, check the restrictions on your title. there normally is an easement.

well, you have to be prepared to fight off any attempt to remove your garden. but again look at deed of restrictions if you have the right to have that garden in the first place.
