Attorney, tapos na po ang hearing sa fiscal level, nakasuhan na po ako ng "less serious physical injuries in rel. to RA 7610." na-receive ko na rin po ang resolution, naghihintay na lang po ako ng subpoena para sa schedule for court hearing. Nais ko lang po itanong kung sakaling matalo ako sa kaso, ano po ang maaaring mangyari sa akin--makukulong po ba ako? kasi po sa sobrang tagal ng proseso ng kaso dito sa bansa, unti-unting nawawala ang mga testigo ko. Kapag dininig na po ba ang kaso sa korte, maaari pa po bang mabago ang kaso at maging serious physical injury iyon?

did the child's injuries take more than 30 days to heal? if so, yes, the charge can be increased. how old is the child?

16 years old po siya, hindi po siya na-confine, dinala po siya sa ospital tapos tinahi po ang sugat at nakauwi din siya agad.

your first concern should be to file bail and be present at the arraignment. bide your time, eventually, they may agree to settle.

maraming salamat po sa payo... na-receive ko na po ang resolution, no bail recommended po ang nakasulat doon...tungkol po sa medical certificate ng complainant, 10 days to heal po ang nakalagay doon.

even if you are convicted, you can apply for probation. so just go through the case. hopefully the complainant will eventually settle.

Just wanna know, what if the child who filed the complaint against me with the guidance of her lola is already with DSWD? Is there still a chance of settlement re the case or what is the best thing that I can do?

Hi I need legal advice for my friend. May kinasuhan siya since 2008 pa pero ngayon lang npagdesisyunan sa korte na less serious physical injury. Ang sabi dapat makulong ung suspek for more than 2 months plus kailangang magbayad sa danyos. Pero nung dumating na ung writ of execution nawala na yung pagkakakulong at natira na lang ung magbabayad pero ayaw magbayad nung suspek. Ang sabi sa kanya walang kapangyarihan ang korte na pilitin ang isang taong magbayad kung walang pambayad. Hindi po ba makukulong dapat kung walang pambayad. Para san pa ung nanalo siya kung d naman makukulong o mgbabayad ung suspek? Pati pagpaparegistered mail sagot ng victim. Ano po ba ang dapat niyang gawin? Wala po siyang atty.

he should inquire with the prosecutor how to get a writ of execution.

Atty, he already got the writ of execution and it states there na kailangang magbayad na lang but the suspect refuses to pay.

And atty. last question dapat po kasi hindi lang less serious because according to the medical certificate more than 30 days and in fact lifetime nabasag na po kasi ung jaw nya. is it possible taasan ung isampang kaso even though there is already a decision

Just wanna ask: what if a convicted person applies for a probation but failed to attend the hearing for it? What could happen? Will it affect the decision of the judge to grant the petition?

The mother of my girlfriend led our 11-year old son to file a a complaint (R.A. 7610) against us parents in the Office of the Prosecutor, City of Manila.

It's so convoluted to explain in writing. Medyo exaggerated ang nasa salaysay. obviously concocted and supplied by the maternal grandmother. Based on our son's medico-legal, abrasions lang ang nakalagay and peklat. Walang physical na nangyari.

Rush and quite an imposition. I have no lawyer yet. We are in the rejoinder stage and scheduled to submit it on the 28th of this month. The atty who prepared our counter affidavit said it was a 1 time event.

1. Do I need a lawyer for the rejoinder? What will be the contents?
2. How long do we wait for the resolution?
3. Will I be arrested if the prosecutor finds probable cause?
