im a US citizen, My husband and i got married in 2006 in the philippines and he came to the us Sept 2009. now, he enter the Army this February 28 and I found out that he has a mistress and they already have a child that was born 2008 which I wasn't aware of it. On April 1st of this year I found out that through pictures and they gave the child a bday party, i didnt know that even the olders kids he has before our marriage know about it but no one told me. I know my husband has been sending her money. I also know that his other 3 older kids know where the mistress live and I know the address. He also call her a lot, I just need to get the copy of his phone call list from the calling card provider but I need a case to do that. I also have pictures of my husband and their kids lying down together in a bed and wearing just a brief/underware, pictures from the recent birthday of the kid, and pictures of my husband and his mistress together and some of them their kissing. Please advice what case can I file to my husband and to his mistress?

hayop kayo, do i understand that your immediate objective is to file a case so you can get the phone records? do these pictures have time stamps on when they were supposedly taken? how did you acquire them? (fb?)

my thinking is that the phone list, aside from your own personal satisfaction, would not have much evidentiary relevance.

what i would try to get will be the birth certificate of the kid.
