Considering your admission, you may settle the case amicably before the Prosecutor's Office. As long as the complainant agree to the terms you will offer, the Prosecutor hearing the case may allow. Normally, it is the objective of the law to settle dispute amicably to avoid costly court litigation.

I would suggest that you offer Post Dated checks but just insure compliance otherwise you will be in deep trouble.These checks would guarantee your complainant that you are serious in your effort to pay the amount involved.

lastly, pwede ba na di pumnayag ang complainant na di hulugan kungdi full payment and hilingin sakin na impossible ko na mabayaran kaagad.

egz, in settlement, anything goes. if the complainant will not accept partial payments then you'll have to find some other way to convince them.

atty. regarding case file to me na estafa, kung diko po kaya mag down payment dahil malaki po yong amount like 120,000 up front payment, pwede po ba na diko sundin yong down payment? ang kaya ko po lang is monthly payment. pwede po ba na dipo masunod yong up front payment na gusto nang complainant? settle ko naman po pero yong down payment ang diko kaya kaagad bayaran. need your advise

ang demand po sakin is 120,000 down payment o up front payment then 30,000 monthly for 12 months, ang kaya ko lang po simulan is the monthly payment, yong down payment diko po kaya kaagad bayaran nakiusap ako na babayaran ko yong 120,000 on the 13th month kaso kahit anong pakiusap ko ayaw po talaga tanggapin nang walang DP. ano po ba dapat ko gawin o maaring kung gawin? sabi nang lawyer nya na kausap ko yan ang dapat ko sundin,wala po akong lawyer kasi mag settle naman po ako kaso ayaw po pumayag sa proposal ko. pwede po ba na diko sundin yong demand nang complainant at kung ano lang kaya ko bayaran,yong DP lang naman po ang diko masusunod, please help...dipa ako nag counter affidavit kasi mag settle naman ako,2nd na kamimeeting namin mag kikita nang lawyer nya sa fiscal office 2nd week nang june at pag dipa naayos papasok na daw po at gagawa na ako nag affidavit.

i recommend you begin preparing your counter affidavit. if you don't have the downpayment, i have doubts they will accept only P30,000.

ano po lalagay ko sa affidavit baka pwede nyo ako ma guide? baased sa story ko na di naman po mas lumala lalo na wala akong counsel because i cant afford to get one, pang down payment nga po wala ako what more kumuha nang counsel, ano po pinaka the best gawin or practicall na gawin ko po?ayaw tangapin proposal pwyment scheme ko,wala akong counsel.
