Court Ordered DNA Test

The father of my baby lives in US. We have no established relationship and he claims he's not the father. What steps can I take to have a foreigner give a DNA sample to prove paternity? He doesn't live in the philippes, his in the US.

if you can find a way to fund your case to be filed in the US, the court will require him to undergo a DNA test. but to do it from here and rely on the embassy and the PAO, I don't think it can happen.

I have consulted many lawyers and all of them say that my case will not succeed unless I have unlimited resources, and even then I may not be successful. Lets hope the RH Bill passes so at least people might have a choice for their mistakes.

search for an organization or ngo in the United States who advocates for support for single moms and children. seek their help. don't give up.

and i don't believe the RH believe is about correcting mistakes but avoiding them.

There is no reciprocal arrangements for the enforcement of support orders with the United States. What should I do if I know he is visiting the Philippines?

what i was thinking of was that these groups will help you file a legal action in the united states.

if he is here, you can file some form of criminal case then request a watch list order to keep him from escaping for a max of 4 months.

As far as I can find, there is not such a organization to exist. There are a petition for equal rights to Amerasian children, but still no rights.

My concern. I have no proof of establish of relationship with the father. If I file a criminal action against him on a visit. Can he hire a lawyer and leave me with expenses for a malicious claim or frivilous action - if it is not established of our relationship. Can the criminal claim be for a DNA test. Otherwise I fear my one shot may be lost and the watchlist order lifted.

This should not be so difficult. Other countries have much better legislation to protect child rights with foreign parents. I accept responsibility for my action and will love and nurture my child, but to parents are neded for balance and support. Thansk again.

he can try to sue you, but i doubt it will prosper.

i don't think it is the law which is the problem. it is really difficult to enforce against someone outside the area of your jurisdiction.
