magandang araw po,nais ko po sanang itanong kung may bisa po ang kasal ko,ikinasal po kami sa judge sa sta.cruz laguna 1995,Michelle po ang name ko ang nakalagay po sa marriage contract ay MECIEL ,17 lang po ako pero ginawa pong 19 ang edad ko,ng mag papasa po kami ng birth certificate ng mag apply kami ng marriage contract pinalitan ang name ko ng MECIEL at edad ko sa birth certificate,2004 po kumuha ako ng copy ng marriage contract namin sa NSO,gamit po ang totoo kong pangalan,wala pong lumabas kaya lahat po ng aking reqiurements ay single ako,may BISA po ba ang kasal ko?

your marriage is presumed to be valid until such time that a case is filed to declare it void from the beginning.

if you are planning to marry, you should be aware of the risk that you might be charged with bigamy. eventually you would not be convicted but i don't know if you want to handle the hassle

Tulad nga ng sinabi ni Atyy, pwede kang makasuhan ng bigamy. At kung presumed valid ang marriage mo, may problema rin pagdating sa property relation ninyo ng ex mo. Kailangan padeclare mo ng null and void ang marriage nyo dahil may malakas na ground ka naman. Kumuha ka ng abogado at magfile kayo ng petition to declare yung marriage mo na void from the beginning..

i cannot advise you to simply ignore your first marriage, but if you will insist, you will have to weigh the risk of someone filing bigamy charges against you.

the alternative is to file a petition for declaration of nullity based on lack of legal capacity being 17 at that time.

salamat po sa kasagutan atty,at sa iyo po lost,follow up ko po uli yang pag file po ba ng petition for declaration of nullity ay annulment case po ba? gaano kahaba po ang proseso at magkano po ang magagastos kung mag file po ako ng petitioN? SALAMAT po.GODBLESS..

about a year. cost will depend on which lawyer you acquire. P50k will be a reasonable amount.
