Hi, 8 months na ako dito sa company last week kinausapa ako manager ko na yaw na sakin nung amo ko sa states pinapipilim ako na Mag-resign bibigay sakin ang sahod ko nang half month or ag under ako nang PIP performance Improvement Plan pero kahit daw mag undergo ako dun bali wala un at tatangalin parin daw ako dahil di ko raw maipapasa un sabi ko pagiisipan ko napag desisyonan ko na di ako mag reresign sinabi nila sige mag under ka sa PIP ang kinakatakot ko ngayon hinahanapan nila ako nang butas para matangal ako poaano ako mag uunder sa PIP eh kung nakadesign un para matangal ako legaly under ba ito sa Illegal Dismissal or constructive Dismissal, Tinanong ako kung ano ba fare sakin para mag resign ako ang hiningi ko 5 months nang sahod ko dahil di ko alam kung ilan buwan ako mawalan nangtrabaho at kumuha ako nanag loan base sa inaalkalang magtatagal ako sa trabaho na ito ayaw nila ibigay sa ngayon inaantay ko ung sinasabi nila na iuunder nila ako sa PIP pero di dumadating gabi gabi parin ako pumapasok
pero pinapabayaan lang ako di ako binibigyan nang trabaho so ngayon nahihirapan ako dahil mas gusto ko pa ang may ginagawa kesa ganito nakatunganga paki advice nalng sa situation ko Americano po may ari nang call center salary kop po ay 25k a m onth

there is such a thing called constructive dismissal. this is where the employer makes your employment so unbearable that you are forced to resign. being made to do nothing can be considered constructive dismissal.

i would wait at least a month that you are placed in that situation before taking any action such as filing a complaint at nlrc.

Good Day Atty.

That is my situation right now I do know they are planning something to me to Justify my Dismissal. My question is which case is more better to File agaoints them Illegal or Constructive Dismissal? Should I just wait it out let them plan or gather any evidence againts me so they can Fire me Legally? can I file both illegal & Constructive Dismissal againts them? If I do file Constructive Dismissal can I still continue to work & get paid even if the case is on going? I really need your advice on what to do in my situation. Thank You very much for all the your Help for my situation.

it can only be one or the other, not both. you cannot continue to get paid and file a case. otherwise, it was not unbearable.

i recommend you just sit tight for a while. if the situation has reached two weeks shoot an email (retain a copy) that they have not assigned anything to you. after a month you can leave and file for dismissal. of course, don't expect your last pay to be easily released.

or wait for them to dismiss you.
