I also had my wife admit that they had sex... the guy is now abroad... but still in constant communication with her... My wife also left the house and lived her sisters... And, my goal, as much as possible, is to get custody over our 3 kids, which is below 7rys of age, not to get her in jail. pinag-iisipan ko po na instead na makulong sya, ibigay na lang nya yung custody ng bata sa akin, never to see the kids again or give visitation rights, and oblige her to give child support. Does this essentially drops the adultery case against her and her lover? Is there an option that they still get convicted, but instead of being jailed, she can just agree to the conditions I stated above. Thanks again in advance.

gamedex, the child she is carrying is considered by the law as yours. in the adultery case i am handling, i'm trying to get a dna test because that is solid evidence.

Hello Atty. Hiwalay na po kami ng wife ko since last year. Nahihirapan ako hiramin yung kid namin, once a week ko lang nahihiram, hindi pa pwede overnight. Tuition, grocery ako nagpprovide.

Recently she got pregnant, once lang kami nagcontact so malaki doubt ko na Hindi sakin yun. After few weeks dinudugo sya, we went to her OB and nag pa ultrasound sya. OB advised na pag wala pa din heartbeat iraraspa na sya. Bottom line niraspa sya, found out na inabort nya. She did this without me knowing. Hindi ko pa malalaman kung hindi sinabi ng OB. Doubtful yung turn of events according to the OB (which is her relative). Common sense nalang talaga.

Meron akong suspect na guy. "Bestfriend" nya daw yun. Nahuli ko na nagtxt sa kanya before, found out na yung guy ang nagprovide ng phone line nya, found pics of them together, in short pinagtagpi tagpi ko lahat ng info about that guy. Did my research and investigation.

I can conclude na yun na nga. Let's say madami na ko hawak na evidence EXCEPT pics/video nila together doing the act OR umamin sya. The hardest part is hindi sya umaamin kahit obvious na. Walang closure kung baga.

Wife chooses social life instead of our kid. Madalas wala sa house. Most of the time, ang nagaalaga sa kid namin is her mom. She's 23 by the way and I'm 27.

Thank you AttyLLL. Last question. What about my kid? I understand that below 7 years of age, the kid should be under the care of her mother. Pano kung hindi naman nya napapapasok yung kid sa madaming kadahilanan na mababaw? Malapit lang samin yung school and hindi practical na ihatid sundo ko everyday from laguna to las pinas vice versa. Wife wants me to pick my kid sa kanila tapos ihatid ko din sa kanila. Our house is 5kms away from the school, laguna is 70kms back and fourth.

Kailangan makiusap at madalas magmakaawa pa ko para lang mahiram yung kid namin etc. What can be done legally para mahiram ko yung anak ko ng walang arte? And Im not getting the custody from my wife, gusto ko lang ng fair visitation and paghiram. Pwede din if possible, I can say na mas magiging maayos na bata yung kid namin kung sakin magsstay. Wife prioritizes social life imbis na yung kid namin.

if she is refusing, the best remedy is to file a court complaint for enforcement of visitation rights. you can also try through her bgy first

attyLLL my situation, i was married in the philippines but i had committed infidelity in abroad. now my husband is in the philippines and he found out about this, the only evidence he had was picture when me and my partner is lying on bed but we are covered with blanket, it looks like almost naked but nothing is showing. the person who send the pictures also includes a pregnacy test but negative. can he prove it that it was mine? all pictures he have saved. we also have pictures hugging and with a group. could this be a strong evidence for infidelity case to me? then i heard about a dna test where a it will show result that we engaged in sexual intercourse?

if saving your marriage isn't an issue, then i don't think you have anything to worry about. acts committed outside of ph territory are not covered by our criminal laws.

i dont want to save my marriage, my concern was my husband wants the full custody of my daughter. if we are not separated or annulled can he file the custody first before separation or annulment? thank you...
