Arresto Menor

Hello!
Gusto ko lang humingi ng legal advice regarding sa previous employer ko. Isang mag asawang doctor ang employer ko. Nag apply ako sakanila bilang isang Medical Secretary or Clinic Secretary. Ito ang unang work ko. 2016 nagstart ang clinic nila at ako na rin ang unang secretary nila dun. Ang sabi sa akin ng lalaki na doctor nung nag apply ako na 1. Ang trabaho ko raw ang mag appointment ng mga patients for check up, magschedule ng operation sa OR, magdeposit sa bank. 2. Meron daw Annual Increase 3.Benefits ng SSS at Philhealth only. After nun, nung natanggap na ako ihahanda niya daw ang contrata at hiningi nila mga requirements ko kasama ang SSS number at philhealth number. Understood na yun na sila na ang mag-ayos at maghuhulog.

Ilang buwan kong paulit naipinaaalala yun sakanila pero paulit ulit rin ang dahilan niya na nakakalimutan daw nila pero aayusin daw nila. Hanggang sa nabuntis ako at kailangan kong mag file ng maternity leave sa sss at nalaman ko na wala pa pala silang naihuhulog at hindi pa naayos. Samakatuwid, wala akong napala sa SSS. Pati ang pagbigay ng 13th month pay ay parang labag pa sa loob nila. Naiopen ko sakanila na dahil sa wala akong hulog kaya wala akong nakuhang maternity leave at ang sabi pa saakin ay yung 13th month na daw na yun ang bigay nila.
Nagtagal pa ulit ako sakanila ng 1year pero hanggang sa nagresigned ako wala akong natanggap na kahit anong benefits.

Ano po ang pwede kong gawin para makuha ang dapat benefits ko or kaya bang makasuhan sila sa ginawa nilang ganon?

Sana po may makuha akong sagot dito.

You should go to the nearest Regional DOLE office and seek the legal advice of their legal officers there regarding your situation.

You definitely have a case of Unfair Labor Practice, as far as I know. All the benefits you mentioned are mandated by our laws and such are mandatory to be received by an employee. There are succeeding penalties for non-compliance of such.
