Good Day Atty.
I just bought a land from the land Tenant measuring 2,400 sqms. I was convince by the story of my nighbors who had also brought a land to this Tenant. Ang kwento kasi nitong Matanda na Tenant was since 1959 siya ang nilagay ng may ari ng malawak na lupa which is let us say gubat pa talaga ang lupain na iyon noon. Since then ni kahit anino man lang ng May-ari ng lupain na yun ay hindi man lang niya nakitang bumisita sa lupa na yun. Bale nilagay lang ang Matanda na tenant na ito doon sa lupa without receiving any salary from the land owner, so ang ginawa na lang nila para mabuhay ay nagsaka at nagtanim na lang ng mga prutas. Until dumating ang point na dahil sa sobrang lawak ng lupain ay di na nila masikaso ng pamilya niya , so he decided to sale some piece of the land(Lot by Lot) which is some of the people including me had bought it. So the buying of the land was settled by the certain amounts of money that they are asking,and a written agreement of transfer of rights from the tenants to the buyer, plus a written agreement which signed by the Barangay Capt., Tenants, Buyer, and some witnesses. Ang tanong ko lang po ay since itong lupa na ito ay pinabayaan na ng Totoong nag mamay-ari may karapatan po ba ang tenant nito na magbinta? May pag-asa ba kaming mga nakabili na mapatituluhan ang lote na nabili namin? and lastly pwede ko bang maipa-notaryo sa Abugado ang written agreement namin sa bintahan at bayaran sa lote.
Maraming salamat po, i hope mapaliwanagan nyo ako sa mga tanong na gumugulo sa isipan ko ngayon.

i would not recommend continuing the transaction. one cannot sell what he does not own.

what you are buying are the tenant's rights, not the owner's.
