Unpaid 5-6 LOAN of mother

Good day po.
Ang nanay ko pa ya nagkaron 50k na utang sa 5-6. Hindi naman po sa tinakbuhan nya yung pinagkakautangan nya pero dahil sa tagal po nahindi nya mabayaran yung buong amount lumaki sa nang hanggang 100k. Pero kung susumahin po yung total ng nabayaran ng nanay ko ay umabot nadin po sa 70k. Sa sobrang laki po di na mabayaran ng nanay ko yung kulang pang 30k.
Nagfile po sila ng case against sa nanay ko.
Ano pong maipapayo nyong gawin po namin?

Kailangan nyong kumuha ng abogado para tulungan kayo sa kasong naisampa laban sa inyo. Kung hirap kayo sa pera, subukan nyong pumunta sa PAO para kumuha ng libreng legal representation sa korte. Pero kailangan nyo munang kumuha ng Certificate of Indigency sa Barangay nyo bago kayo tulungan ng PAO.

Kapag nasa korte kayo, makiusap kayo sa nagpapautang na babaan yung kelangan ibayad sa kanila at kung maari ay gawin itong installment para mas madaling bayaran ng nanay mo. Tutulungan naman kayo ng hukuman na magkaroon ng kasunduan na fair sa lahat.

May authority ang court na babaan ang interest rate, so i-request nyo yun sa court (since may kaso na rin naman ang mother mo). Pero kailangan parin nya makumnbinsi ang court kung bakit masyado ngang mataas ang nasabing rate na sinang-ayunan din naman ng mother mo noon sya ay naglo-loan pa lang.

By the way, may pinirmahan bang written loan agreement ang mother mo? Pero kung meron written agreement, hanggang reduction lang talaga ng interest rate ang pwede nyong hilingin sa court. Hindi nyo maipapa-void ang payment of interest.

You should have had the decision of the court either appealed, or you should have filed a motion for reconsideration in court. Ilang araw na bang lumipas bago nagbigay ng decision yung court? 15 days kasi yung period to appeal or file an MR.

If you fail to pay the obligation after the decision of the court becomes final, the other party may file a mandamus in court to compel you to pay the amount you owe the other party as evidenced by the written agreement you adhered to.

A writ of execution means that the case has been decided by the court already and the terms and conditions of the contract are now being asked by the petitioner to be enforced accordingly.

Did you appear in court to at least contest the claim against you? Do you have a lawyer?
