Hello po, good day sa lahat!

May concern lang po ako. Gusto ko na po kasi mag-resign sa work ko ngayon, pero may mga pending commitments pa po kasi na indicated sa contract. Head Teacher po dapat ako but I can't put up with my boss anymore. I haven't trained any teachers yet kasi nasa school registration process pa lang kami. He paid for my training rin sa TESDA. After rin ng probationary period, wala pa akong pinipirmahang bagong kontrata, so parang di rin safe for me.

If ever I hand in my notice, does my boss have the right to impede my resignation? Also, does he have the right to take back what he has paid for the training?

your boss does not have the right to impede your resignation, however your boss can sue you for damages. if i am not mistaken, in an educational institution there is a contract stipulation about leaving during the school year. also, since he paid for the training, he has the right to claim it from you.

Yung setup po namin is English tutorials for foreigners. Kaso, nasa preliminary stage pa lang po kami. We aren't done with TESDA and Immigration registration yet, so di pa po pwede kumuha ng students. So kahit na po nasa TESDA documents yung name ko, and kahit na exclusive for a single institution yung pagiging trainer, he still has the right to claim the training fee? (Feeling ko oo. Business is business eh. Hahaha.)
