Hello po, naka recieve po ako ng termination letter sa company ko, dpt po ba mapasa ko yung answer or NTE ko within 5 days or it should be 5 days para masabing na due process ako? salamat po ng marami. Wink

NTE is Notice to Explain, ikaw bibigyan noon. then you need to submit your answer within 5 days. then tsaka ka nila bibigyan ng termination if terminated ka na

Due process is the twin notice - you were notified of your violation and given you ample time to refute the charges then the notice of termination.

Ganito po kasi ang nangyari june 15 nka receive ako ng termination letter tas june 19 pinasa ko po yung NTE ko june 23 nawalan na po ako ng trabaho. ang nagtanggal skin team leader ko, yung termination letter ko wlang pirma ng hr, hindi din ako na admin hearing which nag request ako sa knila. my laban po b ako kung ddlhn ko ito sa nlrc? I was terminated due to call avoidance.

Unang una, hindi ikaw ang nagbibigay ng NTE. Pangalawa, baka explanation letter ang ibinigay mo. Pangatlo, Baka hindi termination letter natanggap mo kundi NTE.

Kung inamin mo ang kasalanan mo sa explanation letter mo e hindi na kailangan ng admin hearing.

Tignan mo kung Termination ang sanction na nkalagay sa code of conduct nyo. Check mo din kung ano yung nakalagay sa basis ng termination mo. Ano ba nkalagay?

Naguluhan ako sa kwento mo, so linawin lang natin ang proseso sa pagterminate ng employment:

1. Ang employer ay mag-issue ng Notice to Explain (NTE) sa empleyado, na nag-rerequire sa nasabing empleyado na sya ay magsubmit ng kanyang paliwanag sa insidenteng nasasaad doon (ang NTE ay ini-issue ng EMPLOYER). Basahin mo maigi kung ano ang laman ng natanggap mo, kasi pakiramdam ko NTE ang natanggap mo at hindi termination letter.

2. Sunod nyan, ang employee ay magsa-submit ng kanyang written explanation, in response sa NTE na natanggap nya (itong written explanation na ito ay galing sa EMPLOYEE). Malamang ito yung sinubmit mo after mong matanggap yung NTE.

3. Matapos i-consider yung explanation mo, saka pa lang mag-issue ng Notice of Termination yung kompanya mo (heto, EMPLOYER ulit ang nag-iissue nito). Mag-iissue lang ng termination letter after matapos mag-submit ang employee ng explanation nya, or after matapos yung 5-day period na walang naisa-submit na written explanation yung employee. https://www.alburovillanueva.com/dismissal-termination-employment

Hindi sa lahat ng pagkakataon ay required ang admin hearing. Ang importante lang ay, bago lumabas ang termination letter mo, meron na dapat Notice to Explain kung saan binigyan ka ng pagkakataon magpaliwanag. Based sa kwento mo, ikaw na mismo ang nagsabi na nagsubmit ka ng response mo, so muka namang walang nilabag na proseso ang kompanya mo sa pagdi-disiplina sayo.
