Refund for Blocking fee

Hi,

Gusto ko lang po sana malaman kung posible na makuha ang blocking fee na aking binayaran sa isang developer na wala pang LTS. Pero pumirma po ako ng LOI na nagsasaad na ito ay non refundable.

Meron po ba akong laban dun dahil wala pang LTS ang developer?

I think you have a chance of refunding your money. Developers are not allowed to receive money towards the purchase of a house and lot before the issuance of the LTS for that particular project.  This is the first time I've heard of a blocking fee though. It could be a way of circumventing the fact that they don't have an LTS yet.

Submit a written request to the developer, have them receive it.  When they send you a reply (which is most likely a negative one), call/go to the HLURB and enquire if the developer is allowed to receive blocking fees.  Explain what it is and you can proceed from there.  (If it's a legitimate payment, then it cannot be refunded.  If it's not, then you can ask HLURB to mediate between you and developer so that you'll get your money back.)
