Arresto Menor

A portion of our garden wall collapsed because of the recent heavy rains. It was constructed years ago with proper foundation/soil support. However, our neighbor did some work in their garden (after a few months or so) in which they removed a good portion of the soil foundation in their side of the wall, which we think is a major contributor to the collapse.
Can we require them to pay for the repair/reconstruction cost? If yes, how much does each party shoulder for the cost (ie: 50/50, 70/30, ect)? Thank you!

try first to talk to them. party walls are better shared 50-50. If you were to try to make it appear it's their fault and they disagree, it would be your burden to prove the allegation
