Hi,

Ask ko lang po sana ung stipulated sa Art. 95. Right to service incentive leave.

"Every employee who has rendered at least one year of service shall be entitled
to a yearly service incentive leave of five days with pay."

Ibig po ba sabihin, you are entitled for 5 days yearly SIL pag ka isang taon mo plang and moving forward at wala po talagang SIL run sa rendered service mo from the previous year?

mag kakaroon ka pa lang ng SIL starting ng 1 year of service. so pano ka mag kakaroon sa previous year kung di ka pa naka 1 year. so answer to your question is no SIL for your last year.

Hello!

Is there a policy for when is the payout for the SIL conversion? Article 95 only states "end of the year" but is there a specific date or schedule that the employer needs to release unused SIL?

that would depend on company policy. Some companies only convert it to cash when you resign or are terminated. it is cumulative meaning if you dont use it for 10 years, you should have 50 SILs

confused ako,  ang ibang HR ang sabi dapat di kasama, ang sa amin nakasama kasi kinonvert sa cash ang hindi intinarbaho na mga araw/ inavail na leave.
