Hello Guys,

3 questions po.

1. Is it a requirement for a company to convert the SIL Credits to cash if the employees weren't able to use it or used everything? (ie. out of 6 SIL credits, they just used 3, is the company required to give the unused ones' as cash by the EOY)

2. Is it okay for the company to give the employees mandatory or force SIL just to use all their credits?

3. Is it okay for the company to forfeit unused leave credits instead of converting it to cash by EOY? or is it a requirement for it to be carried over the following year if the company choose not to convert it to cash?

1. Govt mandated SIL is only 5. Those are the only ones required to be converted to cash. For example the company grants 10 SILs. If the employee only uses 2, the company is within its rights to convert only 3 to cash and just forfeit the 7. (depending on company policy)

2. Yes SILs can be mandatory. This is to promote wellness among employees.

3. Like #1 it is not a requirement to carry over anything except the mandatory 5.

Just to summarize, the govt requires that 5 Sils for all employees with more than 1 year of tenure. If unused these 5 or whatever is left can be accumulated or converted to cash by year end. (whether they are accumulated or not is at the discretion of the employer.) If the company gives more than 5 SILs, those are subject to the discretion of the employer.
