Spousal Support

May mga questions lang po sana ako sa Spousal Support, ano ano po ang nakapaloob sa support na ito?
- Required po ba na magpadala ng separate allowance si estranged husband para sakin, kahit na may 20K sya monthly na pinadadala as support para sa 6yrs old namin na anak?

- Ang Spousal Support po ba ay applicable lamang sa mga asawang walang trabaho o sakop din po nito ang mga tulad kong may trabaho. Nais ko po sana humingi ng dagdag dahil hindi po sapat ang kanyang padala para saming mag-ina.

- Pwede po ba ako magdemand sa kanya ng amount na need namin?

- Ang demand letter po ba ay pwede manggaling sakin o dapat po ay galing sa Attorney?

Ibig sabihin po ba nun ay hindi ko po magagamit ang RA 9262 laban sa kanya?

I am honestly peeved at women who just use Republic Act No. 9262 just to squeeze a person for more money.

If this person winds up in jail, obviously he will not be able to work and provide the amount you are demanding. Unless that is the goal?

I do understand that attorney, my main concern here is that he is spending his entire money for the annulment case he filled against me and he cant even increase our monthly allowance.
I know 20K is too much para sa 6 years old, but he also needs to consider na may needs din ako plus im supporting my parents as well.

Sabi nya un lang ang kaya nya, at hindi naman daw kayang ubusin ng anak namin ang 20k sa loob ng isang buwan.

Hindi naman din po ganun kalakihan ang sahod ko, halos kasing laki lang din ng binibigay nyang allowance samin.

Since aware ka naman na sobra sa 6 year old na bata ang 20k, ano ang justification mo for requesting more? Kung kinukulang ka dahil sa pag support mo sa parents mo, unfortunately, hindi na yun problema ng asawa mo.

Pinakita ko sa kanya ang breakdown ng expenses namin at valid naman ang lahat ng iyon, walang luho o kung ano pa man.

Nakabreakdown ang lahat at kita naman nya na wala ng natitira sa bigay nya kadalasan ay kulang pa, halos nagagamit ko na un sarili kong pera para pangtawid namin sa araw-araw.

kung kaya nya tustusan ang annulment bakit hindi nya kayang taasan ang bigay nya, tutal may pera naman sya.

keep in mind na hati din kayo sa pag support sa anak nyo.

if your not happy with him filling for annulment, then just go to court and contest. that way mananatili kayong kasal at pwede nyo ayusin relationship nyo at hopefully maresolve issue nyo financially.
