Hello,
Mangandang araw po.
Humihingi po ako ng payo sa problema namin sa lupa. Apat po kaming magkakapatid, lahat po nasa legal age na. Meron pong nabiling lupa (400 sq.m) yung mga magulang namin noong 1998. Nung panahon na yun, nagdesisyon ang mga magulang namin na ipangalan yung titulo ng lupa sa panganay namin upang sa ganun, sya na balaha na maghati-hati sa aming magkakapatid. Gumawa po sila nun ng deed of sale na pirmado ng seller at nung kapatid naming panganay, ang kaso po, di ito na-notarize at mula nung time na yun hanggang ngayon, di pa rin po ito narerehistro sa pangalan ng panganay namin. Nakapagtayo na rin sya ng maliit na bahay dun. Nung namatay yung tatay namin last year, nag-iba ang ihip ng hangin, gusto na nyang solohin ang lupa at ayaw na nyang hatiing ito sa apat. Ipinagkakalat pa nya sa sya daw ang may-ari nung lupa dala yung deed of sale na gawa pa noong 1998.

Yung seller pala ay nandun pa rin sa amin...at pwede nyang patutuhanan na ang mga magulang namin ang bumili ng lupa. Pwede ba kaming pagawa ulit ng deed of sale na pipirmahan ng nanay namin at nung seller? May bisa pa ba yung naunang deed of sale? May habol pa po ba kmi sa lupang ito? Ano ang nararapat naming gawin?

is the property covered by a title registered at the Register of Deeds?

yes atty it is registered and in the name of the seller.

where is the title? is it still with the owner?

a non-notarized deed of sale is still valid between the parties. nevertheless, if you do indeed re-purchase the property and have it transferred, it will be your brother's burden to attack the title. if he is in possession of the property, it will be difficult to get him out though.

Thanks for the reply atty. Sorry for the insufficient information that i gave. Here's additional info about the lot, the mother lot area is 2500+ sq.m (title is with owner) and being subdivided into several lots and one of it is the 400 sq.m lot that we bought which is not registered since then. The structure/house that my brother built is on the corner of the lot, so we can still subdivide it into four.

the question then is whether the owner is willing to issue a deed of partition and sale. if you can convince them to do so, then you can have individual titles.

it will be best to negotiate with your brother. he should know he didn't pay for it, but he may be threatened because his house is there.
