Hi how are you? I hope you can help and answer my question in regards to marrying again in the Philippines.
I am a Canadian citizen who married a Filipino national in the Philippines 10 years ago, I sponsored him to Canada and months later he arrived here.
Unfortunately 5 years ago we both decided that our marriage has failed and we filed for divorce. He already acquired canadian citizenship at the time of divorce.
A few years ago I met someone new in the Philippines, he is also a filipino national and fell in love. He proposed to me and I said yes. Can I remarry with no hassles?
From my understanding I don't have to file for a recognition of divorce in the Philippines, because the only purpose of this is TO CAPACITATE THE FILIPINO EX SPOUSE TO remarry; I am NOT A Filipino citizen NOR my EX HUSBAND WHEN I FILED FOR A DIVORCE, so WHAT IS THE USE or purpose OF THE petition for RECOGNITION OF DIVORCE? Filing a petition for foreign divorce recognition is only relevant for a filipino spouse, I am correct?
I'm confused because some are telling me that I don't have to worry about it because I can remarry, I just need to get a "Certificate of Legal Capacity to Contract Marriageā from the Canadian embassy, the same as I did when I first got married in the Philippines.
Some are also saying that a case must be filed before the RTC of the city/province where the local civil registrar is located, and that I need legal representation, and that it would cost me about 50-100php; and apparently this process will take about a year to complete.
Anyways I'd rather want a professional to give me an answer to my concern; hope you can help. Thanks.
