Hi po.
May ka work po ako nag file sa dole for illegal dismissal
Ang gusto po nyang mangyari una bayaran sya nang separation fee and moral damages pero ang sabi noong mediator sa sena entitled lang po sya sa separation fee and nagdecide po na may 2nd sena

Ang problema po is ung kawork ko is nagtext po sa company po na bayaran nlng sya nang 50k or else pag hindi na binigay gusto nya aakyat daw nya sa nlrc.
Tanong ko po may fault po ba syang magthreat sa company nang ganun?

ok lang yun, kung yun ang gusto nya. everyone has the right to file sa nlrc, if mananalo ba sya thats another story

nasa negotiation po nila yan.. kahit naman iakyat nya sa NLRC yan.. i tr try pa din inegotiate yan.. so kung papayag yung company nyo.. maaring mas makakatipid sila na bayaran na lang na 50T tapos papipirmahin nang quitclaim yung employee.. kesa mag hire pa sila nang abogado..

you are in mediation. the demand for 50k is actually just an offer. It is up to the company whether to accept or reject. she should be prepared to go to nlrc and file position papers and her evidence
